These Terms govern your relationship with PeekTag ApS ("PeekTag", "we", "us", or "our") and your use of our websites, applications, APIs, integrations, creator tools, AI-powered features, payment features, templates, digital storefronts, and interactive experiences called Tags (collectively, the "Service").

Additional policies may apply to specific parts of the Service, including our Privacy Policy, Cookie Policy, Payment & Refund Policy, Intellectual Property Policy, and PeekAI Terms. If a specific policy or written agreement applies to a feature and conflicts with these Terms, that specific policy or written agreement controls for that feature.

1. Eligibility

You must be at least 13 years old, have the legal capacity to enter into a binding agreement, provide accurate account information, and use the Service only where it is lawful for you to do so. Users under 13 may only access approved educational services where permitted by law and with any required consent.

If you use PeekTag on behalf of a company, organization, school, agency, or other legal entity, you represent that you have authority to bind that entity to these Terms.

2. Your Account

You are responsible for keeping your account and login credentials secure, maintaining accurate account information, all activity performed through your account, and promptly notifying PeekTag if you suspect unauthorized access, credential compromise, or a security incident.

You may not share your account in a way that bypasses plan limits, security controls, or payment obligations. PeekTag may suspend or terminate accounts that contain false information, are used by unauthorized persons, or are used after a prior suspension or ban.

If you register using a company, school, or organization email address, or join a shared team, workspace, or organization, that organization may gain administrative control over your account and related data. Organization administrators may manage members, billing, roles, content access, and workspace settings.

3. About PeekTag

PeekTag is a platform for creating, publishing, sharing, and monetizing interactive experiences called Tags. Tags may include interactive templates, AI-powered workflows, forms, media, user submissions, payments, tokens, credits, paid access, third-party integrations, digital storefronts, commerce experiences, automations, agents, and developer integrations.

Some features are free. Others require subscriptions, credits, usage-based fees, platform fees, or third-party payment processing.

4. License to Use the Service

Subject to your compliance with these Terms, PeekTag grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Service for your personal, creator, internal business, or approved commercial purposes.

You may not copy, resell, lease, host, reproduce, distribute, reverse engineer, decompile, interfere with, or commercially exploit the Service except as expressly allowed by PeekTag or applicable law.

PeekTag may update, modify, suspend, replace, deprecate, or discontinue features, models, integrations, templates, APIs, or parts of the Service over time. We do not guarantee the continued availability of any specific model, provider, feature, template, or integration.

5. Usage Limits and Fair Use

PeekTag may apply usage limits, including limits on API calls, request frequency, concurrency, automated actions, file size, payload size, bandwidth, storage, compute capacity, AI generations, credit usage, queue priority, number of Tags, templates, workflows, storefronts, submissions, or any other parameter reasonably needed to protect the Service.

Usage limits may vary by plan, feature, subscription tier, documentation, account settings, or technical response. PeekTag may enforce limits through throttling, rate limiting, queuing, temporary suspension, credit deduction, or other technical measures.

You may not bypass or evade usage limits, including by creating multiple accounts, distributing requests across accounts, sharing credentials, abusing free trials, scraping, or using automated tools in a way that harms the Service or other users. Plans described as unlimited, high-volume, or similar remain subject to fair-use limits, technical capacity, queue availability, safety controls, and abuse prevention.

6. Content Ownership

You retain ownership of content you create, upload, submit, publish, or otherwise provide through PeekTag, including text, images, videos, files, prompts, product data, templates, workflows, Tags, and submissions ("Your Content").

By using PeekTag, you grant PeekTag a limited, worldwide, non-exclusive, royalty-free license to host, process, store, reproduce, display, transmit, adapt, and analyze Your Content solely as needed to operate, secure, and provide the Service; generate, publish, share, or deliver the Tag or workflow you request; provide support, troubleshooting, moderation, analytics, and abuse prevention; improve the Service subject to our Privacy Policy and your AI training preferences; comply with law; and enforce these Terms.

You represent that you have all rights, permissions, licenses, releases, and consents required to upload, use, publish, process, or monetize Your Content. This includes rights relating to copyright, trademarks, privacy, publicity, likeness, voice, product images, personal data, and third-party assets.

If you publish a Tag, template, storefront, profile, comment, review, or other content publicly, other users and visitors may view, interact with, share, embed, save, or otherwise use it according to your settings and the design of the Service. You are responsible for choosing the appropriate visibility and access settings.

PeekTag does not automatically verify that your content, product data, media, likenesses, designs, or generated outputs are cleared for your intended use. If you send suggestions, ideas, comments, or other feedback to PeekTag, we may use them without restriction, attribution, or compensation.

7. AI-Generated Content and PeekAI

PeekTag may provide AI-powered features, including content generation, assistants, workflows, recommendations, automations, virtual try-on, and other AI experiences ("PeekAI").

You retain ownership of your prompts, files, images, videos, instructions, and other inputs ("Inputs") and the content generated in response ("Outputs"), to the extent ownership is available under applicable law.

You are responsible for reviewing Outputs before using, publishing, selling, or relying on them. Outputs may be inaccurate, incomplete, biased, offensive, outdated, similar to outputs generated for other users, or subject to third-party rights. PeekTag does not guarantee that Outputs are unique, original, legally cleared, accurate, or suitable for a specific purpose.

PeekTag does not use your non-public content to train AI models unless you explicitly opt in or as otherwise described in the Privacy Policy. Public content, feedback, aggregated data, de-identified data, and operational data may be used as described in our policies and settings.

Where required by law, platform policy, or context, you must disclose that content is AI-generated or AI-assisted. You may not remove or obscure provenance signals, watermarks, labels, metadata, or other AI disclosure mechanisms applied by PeekTag or a third-party provider.

If a feature uses a face, body, voice, image, video, or other identifiable attribute, you must have all required rights, permissions, disclosures, and consents from the person depicted or recorded. You may not use PeekTag to identify, verify, authenticate, or classify a person by biometric or sensitive attributes unless PeekTag expressly provides an approved feature for that purpose and applicable law permits it.

Outputs do not constitute medical, legal, financial, tax, accounting, safety, or other professional advice.

8. Acceptable Use

You may not use PeekTag for illegal activities; fraud, impersonation, phishing, scams, or deceptive conduct; harassment, threats, hate speech, or discriminatory content; content that exploits, sexualizes, endangers, or harms minors; non-consensual intimate imagery; malware, credential theft, vulnerability exploitation, or security attacks; spam, abusive automation, unauthorized scraping, or unauthorized data harvesting; intellectual property infringement; circumventing platform restrictions, usage limits, safety systems, or moderation controls; prompt injection, jailbreaks, or attempts to bypass safeguards; harmful, violent, extremist, or self-harm content; inferring or classifying sensitive personal attributes of identifiable individuals except where lawfully provided for a feature that relies on them; uploading sensitive personal information, credentials, payment card data, protected health information, government identifiers, or similarly regulated data unless PeekTag expressly supports and authorizes that processing; or using the Service or Outputs to train, fine-tune, distill, or improve competing AI systems except where expressly allowed by PeekTag in writing or by applicable law.

Violations may result in content removal, refusal to process content, reduced visibility, account suspension, account termination, loss of access to paid features, reporting to payment providers or law enforcement where appropriate, and other measures reasonably needed to protect PeekTag, users, third parties, and the public.

9. Monitoring, Moderation, and Reporting

PeekTag may, but is not required to, monitor, review, filter, moderate, remove, disable, restrict, or refuse to process content, Tags, submissions, Outputs, accounts, or activity.

PeekTag may take action if we believe that content or activity violates these Terms or another PeekTag policy; infringes rights or creates legal risk; threatens the safety, security, integrity, or availability of the Service; harms users, third parties, or the public; or is required to be restricted by law, court order, regulator, payment provider, app store, model provider, or infrastructure provider.

PeekTag may disclose information where we believe in good faith that disclosure is reasonably necessary to comply with law, enforce these Terms, respond to legal claims or safety issues, provide support, prevent fraud or abuse, protect rights or property, or preserve the security of the Service.

10. Third-Party Services and Connected Accounts

Certain features rely on or connect to third-party services, including payment providers, app stores, analytics tools, cloud infrastructure, AI model providers, ecommerce platforms, social platforms, maps, storage providers, and automation tools. Examples may include Stripe, Apple, Google, OpenAI, Microsoft Azure, Anthropic, Shopify, and other approved providers and integrations.

Third-party services are governed by their own terms and policies. PeekTag does not control third-party services and is not responsible for their availability, security, decisions, content, actions, outages, data handling, or changes.

If you connect a third-party account or integration to PeekTag, you represent that you have authority to do so and authorize PeekTag to access and process the data necessary to provide the connected feature. You are responsible for your selection, setup, permissions, configuration, and use of connected accounts.

11. Developer Access, APIs, Automations, and Agents

If PeekTag provides APIs, webhooks, integrations, automation tools, model context protocol connections, developer keys, tokens, scripts, or other programmatic access ("Developer Access"), this section applies.

API keys, tokens, secrets, and credentials are confidential. You must not sell, share, publish, embed in client-side code, expose publicly, or transfer them without authorization. You are responsible for all activity using your credentials, whether or not authorized by you.

You must notify PeekTag promptly if you know or suspect that credentials have been compromised. PeekTag may rotate, revoke, limit, or suspend credentials where necessary to protect the Service.

You are responsible for applications, scripts, workflows, automations, agents, or integrations you build or operate using PeekTag. You must ensure that your end users comply with these Terms and that you provide legally adequate notices and obtain required consents for data processed through PeekTag.

You may not offer standalone access to PeekTag, resell Developer Access, act as a pass-through service, or use automation in a way that avoids fees, safety controls, or usage limits unless PeekTag expressly permits it.

If you connect PeekTag to an AI agent, automation platform, browser automation, orchestration tool, or third-party assistant, all actions taken through that connection are treated as your activity. You are responsible for Inputs submitted, Outputs generated, third-party interactions, transactions initiated, and any harm, cost, or liability arising from that automated use.

PeekTag may change APIs, schemas, endpoints, tools, model availability, integrations, or developer features. You are responsible for keeping your applications compatible. Beta, preview, experimental, or early-access features may change or stop working at any time and are provided without warranty.

You must not exploit or publicly disclose vulnerabilities in the Service before giving PeekTag a reasonable opportunity to investigate and remediate. Security reports may be sent to [email protected] or another security contact designated by PeekTag.

12. Payments, Subscriptions, and Credits

Paid plans renew automatically unless canceled before the renewal date, unless otherwise stated at checkout or required by law. By subscribing, you authorize PeekTag and its payment providers to charge your selected payment method for recurring fees, applicable taxes, and approved charges.

If payment fails, PeekTag may retry payment, request updated billing information, limit access, suspend paid features, or terminate the subscription after any required notice or cure period.

You may cancel a subscription through your account settings, the applicable app store, the payment provider, or the support method made available by PeekTag. Cancellation stops future renewals but does not automatically delete your account or content. You may continue to access paid features until the end of the current paid term unless otherwise stated or required by law.

PeekTag tokens, credits, or usage balances ("PT Credits") are digital usage credits only. They are not currency, stored value, electronic money, gift cards, or property. PT Credits may be linked to your account or workspace, consumed by eligible features, vary in cost or usage rate by feature or provider, expire or fail to roll over, and are not transferable, sellable, reloadable, or redeemable for cash except where required by law.

Payments may be processed through Apple In-App Purchase, Stripe, Google, or other approved payment providers. Additional provider terms may apply. Refunds, credits, chargebacks, VAT, taxes, app-store purchases, trials, promotional offers, and creator payouts are handled as described in the Payment & Refund Policy, checkout disclosures, applicable provider terms, and mandatory consumer law.

If you are a consumer in the EEA, UK, or another jurisdiction with mandatory withdrawal rights, those rights remain unaffected. For digital content or services made available immediately at your request, your withdrawal or refund rights may be limited once performance begins or credits are used, to the extent permitted by law.

13. Seller Payouts and Monetization

When creators, sellers, agencies, brands, or other users monetize content through PeekTag, payouts may be handled through Stripe Connect Express or another approved payout provider. Sellers are responsible for taxes, invoices, consumer disclosures, refunds, product claims, fulfillment, and legal compliance unless PeekTag expressly assumes a duty in writing.

PeekTag may collect platform fees, payment processing fees, taxes, compliance costs, or commissions. Payouts may be delayed, withheld, reversed, or restricted due to fraud checks, chargebacks, legal requests, policy violations, sanctions screening, missing verification, tax issues, or payment-provider requirements.

PeekTag may remove or restrict monetization features if content, products, sellers, or transactions create legal, payment, safety, reputational, or operational risk.

14. Intellectual Property

All PeekTag software, branding, designs, databases, templates, documentation, APIs, models, interfaces, workflows, icons, trademarks, trade dress, and platform technology remain the property of PeekTag ApS or its licensors.

You may not copy, reproduce, resell, or redistribute the Service; reverse engineer, decompile, or extract source code except where applicable law prohibits that restriction; remove copyright notices, watermarks, attribution, provenance signals, or proprietary markings; use PeekTag branding in a way that implies sponsorship, endorsement, or affiliation without permission; or register confusingly similar names, marks, domains, or social handles.

Published pages, embedded experiences, templates, storefronts, or free plans may display a "Made with PeekTag" or similar attribution unless PeekTag offers and you purchase or receive an attribution-removal option.

15. Intellectual Property Complaints

To report intellectual property infringement, email [email protected]. Please include enough information for PeekTag to identify the work, the allegedly infringing content, your contact details, and your good-faith basis for the complaint.

PeekTag may remove, disable, restrict, or refuse to process content that appears to infringe third-party rights. Submission of a license, consent, or ownership document does not guarantee that content will be approved or restored. Repeat infringers may have their accounts suspended or terminated.

16. Disclaimer

The Service is provided "as is" and "as available." To the maximum extent permitted by law, PeekTag disclaims warranties of merchantability, fitness for a particular purpose, non-infringement, uninterrupted availability, error-free operation, security against all threats, and accuracy or reliability of Outputs, analytics, recommendations, or third-party services.

PeekTag is not responsible for delays, degraded performance, queue times, lower Output quality, outages, data loss, or failed tasks caused by third-party infrastructure, model providers, cloud providers, payment providers, app stores, connected accounts, user instructions, excessive usage, or events outside our reasonable control.

17. Limitation of Liability

To the maximum extent permitted by law, PeekTag is not liable for indirect, incidental, special, consequential, exemplary, punitive, or similar damages; loss of profits, revenue, goodwill, data, content, business opportunity, or anticipated savings; or damages arising from third-party services, user content, Outputs, or your use of the Service.

PeekTag's total liability is limited to the greater of EUR 100 or the amount paid by you to PeekTag during the 12 months before the event giving rise to the claim. This limitation does not limit liability that cannot be limited under applicable law, including mandatory consumer rights, fraud, intentional misconduct, or death or personal injury caused by negligence.

18. Indemnity

To the extent permitted by law, you agree to indemnify and hold PeekTag, its officers, employees, contractors, affiliates, and partners harmless from claims, losses, liabilities, damages, costs, and expenses arising from Your Content, Outputs, your misuse of the Service, your violation of these Terms, your violation of third-party rights, your violation of export control, sanctions, tax, consumer, or data protection law, or disputes between you and a third party relating to your use of the Service. This does not require consumers to indemnify PeekTag where such indemnity is prohibited by mandatory law.

19. Termination, Account Deletion, and Data Retention

You may stop using the Service at any time and may request account deletion through the available account controls or by contacting PeekTag. Subscription cancellation is handled separately under the Payments section and the Payment & Refund Policy.

PeekTag may suspend or terminate access if you violate these Terms, create legal or security risk, fail to pay fees, misuse Developer Access, circumvent limits, infringe rights, harm minors, distribute unlawful content, or if continued provision of the Service becomes unlawful or impractical.

After account deletion or termination, access may be removed and content may be deleted. PeekTag may retain records where required or permitted by law, for fraud prevention, dispute resolution, accounting, tax, security, legal compliance, backups, or legitimate business purposes. Aggregated or de-identified data may be retained where it cannot reasonably identify you.

20. International Use, Export Control, and Sanctions

You are responsible for complying with local laws where you access or use the Service. You may not use, export, re-export, or transfer the Service in violation of applicable export control, sanctions, or trade laws. You represent that you are not located in a prohibited jurisdiction and are not on any applicable sanctions or restricted-party list.

21. Governing Law and Disputes

These Terms are governed by the laws of Denmark, without regard to conflict-of-law rules. Any disputes shall be resolved through the courts of Copenhagen, Denmark, unless mandatory consumer protection laws require another forum or law.

Consumer rights under Danish, EU, EEA, UK, or other mandatory consumer protection laws remain unaffected.

22. General Terms

PeekTag may update these Terms by posting a revised version and updating the "Last updated" date. For material changes, PeekTag will provide reasonable notice through the Service, email, account notice, or another appropriate method. Continued use after the effective date means you accept the updated Terms.

You agree to receive service notices, legal notices, product updates, billing messages, and security messages electronically. You may unsubscribe from marketing communications, but transactional and legal notices may still be sent.

You may not assign or transfer your account or rights under these Terms without PeekTag's prior written permission. PeekTag may assign these Terms in connection with a merger, acquisition, restructuring, sale of assets, or by operation of law.

Neither party is liable for delays or failures caused by events beyond reasonable control, including natural disasters, war, terrorism, government actions, pandemics, cyber attacks, internet outages, major cloud provider failures, labor disputes, energy shortages, or failures of third-party providers.

If part of these Terms is unenforceable, the remainder remains valid. Failure to enforce a provision is not a waiver. The English version controls in case of translation conflicts. These Terms, together with applicable policies and written agreements, form the entire agreement between you and PeekTag for the Service.
